By continuing to use the Bernell site, you agree to comply with and be bound by all of the terms and conditions set out below. We reserve the right, at our sole discretion, to modify these terms and conditions at any time, and any such modifications shall be effective immediately upon posting of the modified terms and conditions. You agree to review the terms and conditions periodically to be aware of such modifications and your continued use of the Bernell site shall be deemed your conclusive acceptance of the terms and conditions as modified from time to time.

Reasonable efforts to include accurate and up-to-date information on www.bernell.com, will be made by Bernell. However, Bernell assumes no liability or responsibility for any errors or omissions in the content of the site.

You may not reproduce, perform, create derivative works from, republish, upload, post, transmit or distribute in any way whatsoever any Materials from the Site (or any other Web site owned or operated by Bernell or its subsidiaries or affiliates) without Bernell's prior written permission. However, you may print in hard copy portions of the Site with the sole intent of placing an order with Bernell or applying for credit. Unsolicited Ideas Policy

Bernell does not accept or consider unsolicited ideas, including new or improved products or technologies, product enhancements, ideas for new advertising campaigns, new promotions, processes, materials, marketing plans or new product names. Please do not submit any unsolicited ideas, original creative artwork, suggestions or other works ("submissions") in any form to Bernell or any of our employees. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Bernell's products or marketing strategies might seem similar to ideas submitted to Bernell.

If, despite our request that you not send us your ideas, you still submit them, then regardless of the contents of your letter, the following terms shall apply to your submissions:

  •   → Your submissions and their contents will automatically become the property of Bernell, without any form of compensation to you.
  •   → Bernell may use or redistribute the submissions and their contents for any purpose and in any way.
  •   → There is no obligation for Bernell to review, consider or acknowledge the submission.
  •   → There is no obligation to keep any submissions confidential.

Bernell does, however, welcome your feedback regarding all areas of our business. If you want to send us your feedback, please use the contact us form. Please provide only specific feedback on Bernell's existing products or marketing strategies. Do not include any ideas that Bernell's policy will not permit acceptance or consideration.

Important Note: Bernell does support and assist with the development of new product ideas and bringing new products to market. In these instances, we are open to signing a non-disclosure agreement before listening to any product ideas. However, if a non-disclosure agreement is not in place, then any idea submissions will fall under the "Unsolicited Ideas Policy" of Bernell.

All online orders must be placed using VISA, MasterCard, Discover, and American Express. Returns/Damage or Loss:

Upon receipt of merchandise, it is the customer's responsibility to examine it carefully. Any claims for shortage or damaged goods must be made within 10 days of the invoice date. Merchandise can only be returned within the first 30 days from the invoice date and only after obtaining a return merchandise authorization (RMA) number. To obtain an RMA number, please contact our Customer Service Department at (574) 259-2070. All returns must be sent back in their original product packaging.

If you are claiming that the goods are damaged, you must keep the items in their original shipping materials until they are inspected by the shipping company. Bernell is not responsible for returns that we do not receive or that do not have proper RMA identification. We highly recommend that you use a carrier that can trace your shipment or one that requires a signature.

Products from the low vision pages may be returned within the first 30 days with an RMA, but a 15% restocking fee will apply. Unfortunately, this fee is necessary because many offices loaned different magnifiers to their patients and then began returning any that the patient did not like. We will only allow the return of unused products, unless a product is found to be defective upon first use. These must be reported within the first 30 days from the invoice, as required for all returns.

Special-ordered products are marked as such and are not returnable, as we order them specifically for you and do not normally stock them. All software is non-returnable with no exceptions, but some software items are offered in demos, which we recommend if you are unsure about the software. Vision Therapy starter kits and primary care screening kits are returnable, but a 15% restocking fee will apply. If items that are eligible for return to Bernell are found to be missing parts or are in non-resalable condition, they will be returned to the customer.
